US government lawyers argue that the president has broad legal powers to kill US citizens suspected of links with al-Qaeda who present an “imminent” threat to the country, according to a secret memo leaked on Tuesday.
The justice department document, which was leaked to NBC News, lays out in detail the legal basis upon which the US government can kill Americans in a way that does not contravene a US government ban on assassinations.

The opinion argues that it is lawful to kill US citizens if “an informed, high-ranking official” deems an individual to present a “continuing” threat to the US and it claims that this authority cannot be challenged in court.
“In the department’s view, a lethal operation conducted against a US citizen whose conduct poses an imminent threat of violent attack against the United States would be a legitimate act of national self-defence that would not violate the assassination ban,” the justice department memo says.
The 16-page document appears to be a summary of a 50-plus page classified legal memo that the justice department prepared in 2010. The latter was used to justify the killing of Anwar al-Awlaki, an American citizen and suspected leader of an al-Qaeda affiliate who was killed in a drone strike in Yemen in 2011.
The targeting of US citizens has become the most controversial aspect of the use of armed drones to kill suspected terrorists. The policy began under the Bush administration but has been significantly expanded over the past four years. The US has used drones to target suspected terrorists in countries including Pakistan, Yemen and Somalia.
Jay Carney, the White House spokesman, said on Tuesday: “These strikes are legal, ethical and wise.”
The expanded use of drones is expected to come under scrutiny at the confirmation hearing on Thursday of John Brennan, the president’s counterterrorism chief who has been nominated to head the Central Intelligence Agency.
Mr Brennan has been the driving force behind drone strikes, which increased from around 50 during the George W. Bush administration to more than 350 over the past four years.
The leak comes as a bipartisan group of 11 senators on Monday called on the White House to make public all legal opinions which are used to justify the use of drones for targeted killings and suggested they could stall the nomination of Mr Brennan.
Jameel Jaffer, deputy legal director of the American Civil Liberties Union, which has sued the Justice department to publish the memo, said that the new document claims “sweeping authority” to carry out extra-judicial assassinations. It “underscores both the recklessness of the government’s central claim and the deficiencies in the government’s defence of it”, he said.
The most controversial aspect of the paper is likely to be the broad definition of what it considers an “imminent threat” to the US, arguing that it is not necessary for a specific attack on the US to be in process for an individual to be targeted. It also claims that the courts should play no role in evaluating these judgments. “There exists no appropriate judicial forum to evaluate these constitutional considerations,” it says.
Separately, the Open Society Justice Initiative, a New York-based human rights group, claimed in a detailed report on Tuesday that 54 countries had been involved in the CIA’s extraordinary rendition programme, another of the controversial aspects of US counterterrorism policy from the Bush years. The countries accused of having helped the programme, which saw suspected terrorists kidnapped and in some cases tortured, include Canada, Ireland and Cyprus.
